Terms of Service

These Terms of Service (the “Agreement”) constitute a legally binding contract between you (“you,” “Guest,” “User,” or “your”) and Sunset Inn Apartment Hotel, operating under the trade name The Sunset, located at 1111 Burnaby Street, Vancouver, British Columbia, V6E 1P4, Canada (“The Sunset,” “we,” “us,” or “our”). This Agreement governs your access to and use of:
(a) our website located at https://sunsetvancouver.com
(b) our applications (if any),
(c) all other digital or communications platforms we operate, and
(d) all hotel rooms, extended-stay units, suites, or related accommodations we manage or make available (collectively, the “Properties”), and all services we provide in connection therewith (collectively, the “Services”).

PLEASE READ THIS AGREEMENT CAREFULLY.
BY ACCESSING OR USING THE SERVICES, BOOKING A RESERVATION, ENTERING ANY PROPERTY, OR OTHERWISE INDICATING ACCEPTANCE, YOU AGREE TO BE BOUND BY THIS AGREEMENT IN FULL. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SERVICES OR ENTER ANY PROPERTY.

This Agreement incorporates by reference:

  1. All Additional Terms appended after the Core Terms.
  2. Appendix A – House Rules (collectively, the “House Rules”).
  3. Any written order form, extended stay agreement, limited non-personal use agreement, or other supplemental contract executed by you (collectively, the “Supplemental Agreements”).

In the event of a conflict, the order of precedence is:

  1. Any Supplemental Agreement
  2. Additional Terms
  3. Appendix A — House Rules
  4. This Agreement (Core Terms)

SECTION 1 — DEFINITIONS

For purposes of this Agreement, the following terms have the meanings below:

“Accommodation” means any hotel room, extended-stay unit, suite, furnished housing unit, or similar lodging made available by The Sunset.

“Additional Terms” means the set of supplemental, modular terms included after the Core Terms, including without limitation: Identity Verification Additional Terms; Noise Monitoring Device Additional Terms; Surveillance and Security Camera Additional Terms; Extended Stay Additional Terms; Limited Non-Personal Use (Corporate Housing) Additional Terms; Third-Party Platform Additional Terms; Pre-Arrival Requirements Additional Terms; Unit Condition and Health & Safety Additional Terms.

“Applicable Law” means all laws, regulations, codes, bylaws, and requirements of any federal, provincial, or municipal authority with jurisdiction over the Services, including but not limited to the laws of British Columbia and Canada.

“BC RTA” means the British Columbia Residential Tenancy Act, as amended. Extended stays at The Sunset are licenses of occupancy, not residential tenancies, unless and only to the extent required by Applicable Law under the BC RTA.

“Booking” or “Reservation” means any arrangement for you to access or occupy a Property for a defined period.

“Guest Content” means any content submitted by you, including reviews, messages, images, or communications.

“House Rules” means the rules and policies applicable to conduct during your stay as outlined in Appendix A.

“Limited Non-Personal Use Agreement” means the set of Additional Terms governing commercial, corporate, non-personal, or crew housing uses of any Property.

“On-Site Services” means any services provided at or in relation to any Property, including maintenance, limited staffing assistance, or other offerings.

“OTA” means any online travel agency, booking website, or third-party platform (e.g., Expedia, Booking.com, Hotels.com).

“Property” or “Properties” means all hotel rooms, extended stay units, common areas, elements, and facilities under the control or management of The Sunset.

“Services” means all website, digital, reservation, occupancy, check-in, communications, on-site, administrative, and operational services provided by or on behalf of The Sunset.

“You” or “Guest” means the individual using the Services, making a Reservation, or entering any Property, and includes all individuals invited or allowed by you to access or occupy any Property.


SECTION 2 — SCOPE OF SERVICES

2.1 Nature of Services
The Sunset acquires, leases, manages, or otherwise controls rights in specific Properties and offers Accommodations for short-term hotel stays and longer-term extended-stay arrangements. All use of any Property is provided pursuant to a limited, revocable license to occupy for the duration of an approved Reservation, subject to compliance with this Agreement.

2.2 No Transfer of Property Interest
Your Reservation does not transfer any real property interest, leasehold interest, or estate. You do not have the rights of a tenant unless and only to the extent mandated by Applicable Law. The default and intended characterization is a license to occupy, not a tenancy.

2.3 Services Provided “As Is”
The Services and Properties are provided “AS IS” and “AS AVAILABLE,” without warranty except as expressly provided herein.

2.4 Third-Party Providers
We may engage independent contractors, service providers, or other vendors to support operations. These individuals do not possess authority to bind The Sunset contractually.


SECTION 3 — ACCEPTANCE OF TERMS

3.1 Binding Agreement
By accessing or using the Services, booking a stay, submitting information, or entering any Property, you consent to this Agreement.

3.2 Eligibility
You must be at least 18 years old, legally competent, and legally permitted to enter this Agreement. You represent that all information you provide is complete and accurate.

3.3 Updates to Terms
We may update this Agreement at any time. Changes will be posted on our website with the date of last revision. Continued use after changes constitutes acceptance.


SECTION 4 — ACCOUNTS, BOOKINGS & SUPPLEMENTAL AGREEMENTS

4.1 Account Creation
Certain Services require account registration. You agree to maintain accurate information and secure your login credentials.

4.2 Reservations
Reservations may be made directly through our website or via OTAs. All Reservations are subject to this Agreement, the House Rules, and the Additional Terms, even if the booking was made through an OTA.

4.3 Reservation Confirmation
A Reservation is not confirmed until you receive written confirmation from The Sunset. We reserve the right to refuse any booking for any lawful reason.

4.4 Supplemental Agreements
Extended stays, corporate stays, or stays subject to special requirements may require the execution of additional agreements. These documents form part of this Agreement.

4.5 Inconsistencies
In the event of conflict, Supplemental Agreements control.


SECTION 5 — FEES, PAYMENT TERMS & CANCELLATIONS

5.1 Fees
You agree to pay all fees, including:
(a) nightly or extended stay charges;
(b) applicable taxes;
(c) cleaning fees;
(d) damage fees;
(e) incidentals;
(f) charges for violations of the House Rules;
(g) administrative fees; and
(h) any other charges disclosed at booking.

5.2 Payment Authorization
You authorize us to charge your payment method for all applicable fees. You consent to authorization holds for incidentals or damage risk.

5.3 Currency
Unless stated otherwise, fees are charged in Canadian dollars (CAD).

5.4 Cancellations and Refunds
Cancellation terms are determined at the time of booking. OTA bookings may include stricter or different cancellation policies.

5.5 Delinquent Accounts
We may suspend access or cancel Reservations for failure to pay any amount due.

5.6 Overstays
If you remain beyond your Reservation:
(a) you may be charged overstay fees;
(b) you may be required to vacate;
(c) you may be treated as trespassing;
(d) The Sunset may take lawful steps to remove you, subject to Applicable Law.


SECTION 6 — LIMITED LICENSES

6.1 License to Use the Services
We grant a limited, revocable, non-exclusive license to access and use the Services for personal, non-commercial purposes, except as expressly permitted in a Limited Non-Personal Use Agreement.

6.2 License to Occupy a Property
You receive only a temporary, revocable license to occupy a specific Accommodation for the duration of your Reservation.

6.3 No Tenancy Unless Mandated by Law
Your stay does not constitute a residential tenancy. However, if and only if mandatory provisions of the BC Residential Tenancy Act apply by force of law, such provisions shall supersede conflicting terms of this Agreement to the minimum extent required.

6.4 Entry Rights
We may enter the Accommodation, subject to Applicable Law, for maintenance, safety, suspicion of violations, noise complaints, emergencies, law enforcement requests, or any reason permitted by this Agreement.


SECTION 7 — IDENTITY VERIFICATION & FRAUD PREVENTION

7.1 Requirement to Verify Identity
You agree that, as a condition of booking or occupying any Property, you must complete identity verification, which may include submission of government-issued identification, selfies, biometric comparisons, or other verification methods.

7.2 Third-Party Identity Services
We may use third-party vendors for identity checks. By using the Services, you authorize such checks and consent to the disclosure of verification results to The Sunset.

7.3 Fraud Screening
We may conduct fraud screening, credit screening (where applicable), or background screening to detect risk, abuse, security threats, or unlawful conduct.

7.4 Failure to Verify
Failure to complete required verification may result in:
(a) denial of access;
(b) cancellation of Reservation;
(c) refusal to issue door codes or digital keys;
(d) termination of your stay.

7.5 Access Conditional on Verification
You may not receive access information, such as digital keys, PIN codes, lockbox codes, or check-in instructions, until verification is complete.


SECTION 8 — GUEST OBLIGATIONS & PROHIBITED CONDUCT

8.1 Compliance with Agreement and Law
You agree to comply with this Agreement, all Additional Terms, the House Rules, and all Applicable Laws, bylaws, and building regulations.

8.2 Prohibited Conduct
You shall not, and shall ensure that your invitees do not:
(a) engage in illegal activity;
(b) damage or alter the Property;
(c) exceed maximum occupancy;
(d) create noise disturbances;
(e) violate quiet hours;
(f) interfere with building operations, staff, or other occupants;
(g) engage in harassment, threats, or abusive conduct;
(h) use the Property for commercial purposes without a Limited Non-Personal Use Agreement;
(i) smoke or vape in prohibited areas;
(j) tamper with fire alarms, smoke detectors, CO detectors, or safety devices;
(k) misuse access devices;
(l) prop open doors or compromise building security;
(m) bring hazardous, flammable, or prohibited materials to the Property;
(n) commit fraud or provide false information;
(o) violate any additional rule in the House Rules.

8.3 Events, Parties, and Gatherings
You may not host parties, events, gatherings, or social functions exceeding occupancy limits unless expressly permitted in writing by The Sunset. Unauthorized gatherings constitute a material breach.

8.4 No Unregistered Guests
Unregistered persons may not stay overnight without approval. The Sunset may impose additional charges per occupant.

8.5 Pets
Pets are permitted only where expressly allowed. Unauthorized pets may result in cleaning fees, damage fees, or termination of your stay.

8.6 Child Safety
You are solely responsible for the supervision and safety of children in your party.

8.7 Weapons
No weapons, including firearms, ammunition, explosives, or similar devices, may be brought into any Property, except as permitted by law and expressly disclosed to The Sunset.


SECTION 9 — CONDITION OF PROPERTY, MAINTENANCE & HEALTH/SAFETY

9.1 Condition of Units
The Sunset strives to maintain Properties in good, sanitary, and operable condition. However, you acknowledge that all Properties are provided on an “as is” basis, subject to reasonable wear and tear.

9.2 Guest Responsibilities
You must:
(a) maintain the Accommodation in clean and sanitary condition;
(b) dispose of garbage in the designated manner;
(c) keep doors locked when unattended;
(d) promptly report maintenance or safety issues;
(e) use appliances, fixtures, and amenities safely and as intended.

9.3 Damage Reporting
You must report any damage, breakage, water intrusion, or malfunction immediately. Failure to report may result in increased fees.

9.4 Pests and Infestations
You must keep food sealed, maintain basic cleanliness, and notify us of any pest concerns. You may be liable for costs attributable to your conduct.

9.5 Public Health Requirements
You must comply with public health guidance and requirements, including sanitation protocols, as may be issued by government authorities.


SECTION 10 — NOISE MONITORING & BEHAVIORAL MONITORING

10.1 Noise Monitoring Devices
Certain Accommodations may contain noise-monitoring devices (e.g., Minut or similar). These devices:
(a) measure decibel levels only;
(b) do not record or transmit speech;
(c) may trigger alerts to The Sunset staff if noise exceeds acceptable thresholds.

10.2 Purpose
These devices are used exclusively to:
(a) ensure compliance with quiet hours;
(b) prevent disturbances;
(c) protect building occupants;
(d) investigate violations.

10.3 Consent
By occupying any Property, you consent to the use of such devices.


SECTION 11 — SURVEILLANCE CAMERAS & SECURITY SYSTEMS

11.1 Use of Cameras
Common areas, building entrances, hallways, exterior areas, and other public or semi-public spaces may be monitored by security cameras.

11.2 No Cameras Inside Accommodations
The Sunset does not install security cameras inside Accommodations.

11.3 Purpose
Video surveillance is used for:
(a) security;
(b) fraud prevention;
(c) protection of guests, staff, and property;
(d) compliance with the House Rules.

11.4 Consent
By accessing any Property, you consent to being recorded in monitored areas.

11.5 Reporting to Authorities
We may provide video or audio data to law enforcement when required or permitted by law.


SECTION 12 — ACCESS, ENTRY RIGHTS & INSPECTIONS

12.1 Entry for Safety or Emergencies
We may enter the Accommodation without notice if we reasonably believe there is:
(a) an emergency;
(b) a threat to health or safety;
(c) imminent damage to property;
(d) risk of violation of law.

12.2 Entry for Maintenance or Inspections
Subject to Applicable Law, we may enter on reasonable notice for:
(a) maintenance;
(b) repairs;
(c) inspections;
(d) suspected rule violations.

12.3 Access Devices
Digital keys, PINs, fobs, or lock codes may be changed or disabled at any time for security or operational reasons.

12.4 Failure to Provide Access
If you refuse access, we may treat this as a material breach and may terminate Your stay.


SECTION 13 — MULTI-UNIT BUILDING CONDUCT & USE OF COMMON AREAS

13.1 Conduct in Common Areas
You must:
(a) behave respectfully in hallways, elevators, and shared facilities;
(b) comply with posted building rules;
(c) not obstruct hallways or exits;
(d) not loiter or create disturbances.

13.2 Propping Doors
Propping open exterior doors or allowing unauthorized persons into the building is strictly prohibited.

13.3 Deliveries
Packages or deliveries must be retrieved promptly. The Sunset is not liable for lost or stolen packages.

13.4 Parking Areas
Where parking is provided, you must comply with all rules. Unauthorized vehicles may be towed at your expense.


SECTION 14 — EXTENDED STAY & BC RESIDENTIAL TENANCY ACT CLARIFICATION

14.1 Intended Nature of Extended Stays
All extended stays offered by The Sunset are intended to be and structured as temporary licenses, not residential tenancies.

14.2 BC RTA Applicability
You acknowledge and agree:
(a) The Sunset does not offer its Accommodations as residential tenancies;
(b) You do not acquire tenant rights by signing this Agreement or occupying a Property;
(c) However, if and only if the BC Residential Tenancy Act mandatorily applies by law, its required provisions supersede conflicting terms herein to the minimum extent required.

14.3 No Waiver of Statutory Rights Required by Law
Nothing in this Agreement is intended to contract out of legally mandatory protections.
However, you acknowledge that most extended stays at The Sunset do not qualify as tenancies under the BC RTA.

14.4 Right to Relocate or Substitute Units
For extended stays, we may—where permitted—relocate you to another similar unit during your stay for operational reasons.


SECTION 15 — THIRD-PARTY PLATFORMS, OTAs & INACCURACIES

15.1 Third-Party Booking Platforms
If you book through an OTA or third-party platform:
(a) your booking remains subject to this Agreement, the Additional Terms, and the House Rules;
(b) your relationship with the OTA is governed by the OTA’s terms;
(c) The Sunset is not responsible for OTA errors, system failures, overbookings, or inaccurate representations.

15.2 Inconsistent Descriptions or Errors
Should an OTA display inaccurate or outdated information about any Property:
(a) the information on The Sunset’s official website prevails;
(b) The Sunset is not responsible for OTA content;
(c) misrepresentations by OTAs do not entitle you to refunds beyond those permitted under this Agreement.

15.3 OTA Cancellations and Modifications
Changes must be made through the platform where you booked.
The Sunset may not be able to modify OTA bookings directly.


SECTION 16 — MODIFICATIONS, RELOCATION & UNAVAILABILITY

16.1 Modifications by Guest
Any modification request is subject to availability and may result in additional fees.

16.2 Relocation
The Sunset may relocate you to a similar or superior unit or property if:
(a) the original Accommodation is unavailable;
(b) maintenance or safety issues arise;
(c) operational or building-related constraints require relocation.

16.3 Unavailability or Overbooking
If an Accommodation becomes unavailable prior to or during your stay, The Sunset may:
(a) relocate you;
(b) refund affected nights; or
(c) cancel your stay.

16.4 No Liability for Relocation
Except for refunding prepaid unused nights where applicable, The Sunset is not liable for relocation-related losses, including:
(a) inconvenience;
(b) travel costs;
(c) alternative lodging costs beyond what is specified herein;
(d) emotional distress;
(e) business losses.


SECTION 17 — DAMAGES, FEES & ADDITIONAL CHARGES

17.1 Responsibility for Damage
You are responsible for any damage, loss, or excessive wear caused by you or your invitees, including:
(a) physical damage;
(b) stains or excessive dirtiness;
(c) missing items;
(d) misuse of appliances;
(e) violation of smoking rules;
(f) tampering with safety devices;
(g) unauthorized pets or guests.

17.2 Assessment of Fees
The Sunset may charge:
(a) actual repair or replacement costs;
(b) reasonable administrative fees;
(c) lost income for days the unit is unrentable;
(d) specialized cleaning costs.

17.3 Evidence
We may document damage through photographs, videos, reports, or invoices.

17.4 Authorization
You authorize us to charge your payment method for such fees.


SECTION 18 — PERSONAL PROPERTY, LOST ITEMS & STORAGE

18.1 Personal Belongings
The Sunset is not responsible for loss, theft, or damage to personal belongings, whether stored in-unit, in vehicles, or in common areas.

18.2 Lost and Found
Items left behind may be discarded or donated after a reasonable period.
Shipping lost items back to you may incur fees.

18.3 On-Site Storage (If Offered)
Storage is:
(a) limited;
(b) offered solely as a convenience;
(c) accessed at your own risk;
(d) subject to inspection if required by law or safety concerns.

18.4 No Bailment
No bailment relationship is created. The Sunset does not assume custody or responsibility for stored items.


SECTION 19 — GUEST CONTENT & INTELLECTUAL PROPERTY RIGHTS

19.1 Ownership of User Content
You retain ownership of Guest Content submitted through the Services.

19.2 License to The Sunset
By submitting Guest Content, you grant The Sunset a worldwide, perpetual, irrevocable, royalty-free license to:
(a) use, reproduce, display, publish, modify, translate, distribute, and create derivative works;
(b) use such content for marketing, analytical, operational, or safety purposes.

19.3 Accuracy and Legality
You represent that your content:
(a) is truthful;
(b) does not violate third-party rights;
(c) does not contain unlawful, defamatory, or harmful material.

19.4 Removal
We may remove any Guest Content at any time for any lawful reason.


SECTION 20 — INTELLECTUAL PROPERTY OF THE SUNSET

20.1 Ownership
All website content, branding, software, trademarks, trade dress, designs, text, graphics, and materials are the exclusive property of The Sunset or our licensors.

20.2 Restrictions
You may not:
(a) copy or modify the Services;
(b) reverse engineer or attempt to derive source code;
(c) use branding or trademarks without permission.


SECTION 21 — DISCLAIMERS

21.1 No Warranty
To the fullest extent permitted by Applicable Law, the Services and Properties are provided “AS IS” and “AS AVAILABLE.”

21.2 No Guarantee of Availability
We do not guarantee the availability of any unit, amenity, or feature.

21.3 No Guarantee of Accuracy
We disclaim responsibility for:
(a) errors or inaccuracies in OTA listings;
(b) third-party communications;
(c) user-submitted content.

21.4 No Guarantee of Safety
While The Sunset implements reasonable security measures, we do not guarantee the safety or security of persons or property.


SECTION 22 — LIMITATION OF LIABILITY

22.1 Maximum Liability
To the fullest extent permitted by law, The Sunset’s total liability arising out of or relating to your stay, use of the Services, or access to any Property shall not exceed:
(a) the greater of CAD $100, or
(b) the total amounts paid by you to The Sunset in the twelve (12) months preceding the event giving rise to the claim.

22.2 Excluded Damages
The Sunset is not liable for:
(a) indirect, incidental, special, punitive, or consequential damages;
(b) emotional distress;
(c) lost profits or business interruption;
(d) loss of data;
(e) reputational harm;
(f) replacement lodging;
(g) transportation or travel expenses.

22.3 Applicability
These limitations apply regardless of:
(a) negligence;
(b) breach of contract;
(c) strict liability;
(d) tort claims;
(e) any other legal theory.

22.4 Exceptions
Some jurisdictions may not allow certain limitations; such limitations apply only to the extent permitted.


SECTION 23 — INDEMNIFICATION

23.1 Indemnity by Guest
To the fullest extent permitted by Applicable Law, you agree to indemnify, defend, and hold harmless The Sunset, its owners, affiliates, officers, directors, employees, contractors, agents, and representatives (“Indemnified Parties”) from and against any and all claims, liabilities, losses, damages, expenses, fines, penalties, and costs (including reasonable legal fees) arising out of or relating to:

(a) your breach of this Agreement, the Additional Terms, or the House Rules;
(b) your violation of Applicable Law;
(c) your use or misuse of any Property or the Services;
(d) damage to any Property caused by you or your invitees;
(e) personal injury or property damage caused by you or your invitees;
(f) Guest Content you submit;
(g) disputes between you and any third party;
(h) your negligent, reckless, fraudulent, or intentional acts or omissions.

23.2 Defense and Control
The Sunset may assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate fully with such defense.


SECTION 24 — INSURANCE

24.1 Guest Insurance
You acknowledge and agree:

(a) The Sunset does not provide insurance coverage for your personal property;
(b) The Sunset does not insure against your personal liability;
(c) You are encouraged to obtain renter’s insurance, travel insurance, liability insurance, or other applicable coverage;
(d) Any insurance obtained by you is your sole responsibility.

24.2 The Sunset’s Insurance
Any insurance carried by The Sunset is solely for The Sunset’s benefit and does not confer rights upon you unless required by law.


SECTION 25 — TERMINATION & REMOVAL

25.1 Termination by The Sunset
We may terminate your Reservation or access to the Services—without refund—if:

(a) you violate this Agreement or the House Rules;
(b) you engage in illegal activity;
(c) you endanger staff, other guests, or property;
(d) you provide false or misleading information;
(e) you fail to pay amounts due;
(f) you refuse required identity verification;
(g) you obstruct lawful entry;
(h) you behave abusively or threaten harm.

25.2 Removal from Property
To the extent permitted by Applicable Law, The Sunset may remove you from the Property and disable your access codes, keys, and credentials.

25.3 Effect of Termination
Upon termination:

(a) you must immediately vacate;
(b) you must remove all personal property;
(c) The Sunset may dispose of abandoned personal property after a reasonable time;
(d) you remain liable for all charges accrued.


SECTION 26 — FORCE MAJEURE

26.1 Definition
The Sunset is not liable for delays or failure to perform due to events beyond its reasonable control, including:

(a) natural disasters, storms, floods, fires;
(b) epidemics, pandemics, public health emergencies;
(c) utility outages, mechanical failures, building failures;
(d) government orders, regulations, or restrictions;
(e) labor disputes, strikes, lockouts;
(f) acts of war, terrorism, or civil unrest;
(g) supply chain disruptions, transportation failures.

26.2 Suspension of Obligations
Our obligations may be suspended during such events.

26.3 Refunds for Force Majeure
Refunds may be issued at The Sunset’s discretion, in accordance with Applicable Law.


SECTION 27 — DISPUTE RESOLUTION

27.1 Good Faith Negotiation
Before initiating legal action, both parties agree to attempt to resolve disputes in good faith through written communication.

27.2 Mediation (Optional but Recommended)
Either party may request non-binding mediation before initiating litigation. Mediation shall occur in Vancouver, British Columbia, unless otherwise agreed.

27.3 Court Proceedings
If the dispute is not resolved through negotiation or mediation:

(a) all disputes shall be brought exclusively before the courts of the Province of British Columbia;
(b) both parties consent to the jurisdiction of such courts;
(c) both parties waive objections to venue.

27.4 Injunctive Relief
Nothing prevents either party from seeking urgent injunctive relief to protect rights or prevent irreparable harm.

27.5 Class Action Waiver
To the fullest extent permitted by law, you agree:

(a) claims must be brought on an individual basis;
(b) no class, consolidated, or representative actions are permitted.

If this waiver is deemed unenforceable, the remainder of this Agreement remains in effect.


SECTION 28 — GOVERNING LAW

28.1 Applicable Law
This Agreement is governed exclusively by the laws of:

(a) the Province of British Columbia;
(b) the federal laws of Canada applicable therein.

28.2 Mandatory Statutory Rights
Nothing in this Agreement is intended to override mandatory statutory rights applicable under British Columbia or Canadian law.


SECTION 29 — GENERAL PROVISIONS

29.1 Entire Agreement
This Agreement, together with the Additional Terms, House Rules, and any Supplemental Agreements, constitutes the entire agreement between you and The Sunset.

29.2 Severability
If any part of this Agreement is found invalid:

(a) the remainder continues in full force;
(b) invalid terms are replaced with enforceable ones that reflect the original intent.

29.3 No Waiver
Failure to enforce any term is not a waiver of future enforcement.

29.4 Assignment
You may not assign or transfer your rights.
The Sunset may assign its rights without restriction.

29.5 Interpretation
Headings are for convenience only and do not affect interpretation.

29.6 Notices
Notices must be sent to the contact information on our website. Notices to you may be sent to the email address associated with your Reservation.

29.7 Survival
Sections that by their nature should survive termination shall survive, including payment obligations, indemnification, disclaimers, and limitations of liability.

ADDITIONAL TERMS

The following Additional Terms apply to all Guests and form an integral part of the Agreement. In the event of conflict between these Additional Terms and the Core Terms, these Additional Terms govern.


A. IDENTITY VERIFICATION & FRAUD SCREENING — ADDITIONAL TERMS

A.1 Purpose
To maintain safety, security, and compliance, The Sunset may require Guests to undergo identity verification or fraud screening.

A.2 Verification Methods
You may be required to submit:
(a) a government-issued ID;
(b) a live selfie image;
(c) biometric comparisons;
(d) address verification documents;
(e) payment method verification;
(f) background information as permitted by law.

A.3 Permission to Use Third Parties
You authorize The Sunset to use third-party identity verification vendors.

A.4 Refusal or Failure to Verify
Failure to satisfy verification requirements may result in:
(a) cancellation of your Reservation;
(b) denial of access;
(c) termination of your stay;
(d) notification to law enforcement if fraud is suspected.

A.5 Reverification
The Sunset may require reverification at any time during your stay.


B. NOISE MONITORING DEVICES — ADDITIONAL TERMS

B.1 Device Functionality
Noise-monitoring devices may be installed in certain Accommodations. These devices:
(a) measure decibel levels;
(b) do not record speech;
(c) do not capture personally identifying sounds;
(d) may trigger alerts when noise exceeds thresholds.

B.2 Purpose of Monitoring
Used solely to:
(a) enforce quiet hours;
(b) prevent disturbances;
(c) protect building occupants;
(d) mitigate risks associated with gatherings or parties.

B.3 Consent
By occupying a Property, you consent to the use and operation of such devices.


C. SURVEILLANCE & SECURITY CAMERA DISCLOSURE — ADDITIONAL TERMS

C.1 Camera Locations
Cameras may monitor:
(a) building entrances;
(b) hallways;
(c) lobbies;
(d) parking areas;
(e) exterior spaces;
(f) common areas.

C.2 No Cameras Inside Units
The Sunset does not place cameras inside Accommodations.

C.3 Purpose of Surveillance
Used for:
(a) building security;
(b) protection of guests and staff;
(c) fraud prevention;
(d) monitoring compliance with the House Rules.

C.4 Data Sharing
Footage may be disclosed to law enforcement or third parties where required or permitted by law.

C.5 Retention
Camera footage may be retained for a reasonable period consistent with business and safety needs.


D. EXTENDED STAY — ADDITIONAL TERMS

D.1 Nature of Extended Stays
All extended stays are intended to be licenses of occupancy, not residential tenancies.

D.2 BC RTA Application
The BC Residential Tenancy Act applies only if and to the extent required by law, and only where mandatory provisions override contractual terms.

D.3 Supplemental Agreements
Extended stays may require execution of additional documentation, including:
(a) Extended Stay Occupancy Agreement;
(b) Order Forms;
(c) Background check authorization;
(d) Long-term occupancy rules.

D.4 Background Checks
You may be required to submit to background checks as a condition of an extended stay.

D.5 Right to Relocate
For extended stays, The Sunset may relocate you to an equivalent or superior Accommodation where operationally necessary.

D.6 Multi-Month Obligations
Extended stays may include:
(a) additional safety obligations;
(b) periodic inspections;
(c) specific entry-right provisions;
(d) long-term occupancy rules;
(e) restrictions on assignment or suboccupancy.

D.7 Renewals
Renewals are not guaranteed. The Sunset may refuse renewal for any lawful reason.


E. LIMITED NON-PERSONAL USE & CORPORATE HOUSING — ADDITIONAL TERMS

E.1 Applicability
This section applies when:
(a) a business, organization, or entity books stays for personnel;
(b) units are used for crew housing, temporary staffing, or employee lodging;
(c) a Reservation is paid by a commercial party.

E.2 Non-Personal Use License
Commercial stays are governed by a Limited Non-Personal Use Agreement.
Where no separate agreement is signed, this section governs.

E.3 Responsibilities of Booking Entity
The booking entity is responsible for:
(a) ensuring all occupants comply with this Agreement;
(b) payment of all fees, damages, and charges;
(c) providing accurate occupant information;
(d) ensuring identity verification for each occupant.

E.4 Occupant Changes
Occupants may not be substituted or rotated without written approval.

E.5 Restrictions
Corporate stays may not be used for:
(a) filming or production without written consent;
(b) events or gatherings;
(c) commercial distribution or public access;
(d) sub-licensing or profit-making uses.


F. THIRD-PARTY PLATFORM (OTA) BOOKINGS — ADDITIONAL TERMS

F.1 OTA Terms Control Booking Mechanics
If booked through an OTA, their policies govern booking mechanics, cancellations, and modifications.

F.2 The Sunset Terms Control Conduct
Regardless of OTA terms, your stay is subject to:
(a) this Agreement;
(b) the House Rules;
(c) all Additional Terms.

F.3 OTA Inaccuracies
The Sunset is not responsible for:
(a) inaccurate photos or descriptions on OTAs;
(b) miscalculated taxes or fees;
(c) incorrect amenity listings;
(d) system-driven overbookings.

F.4 OTA Cancellations
If an OTA cancels your booking, The Sunset has no control and no obligation beyond what that OTA requires.


G. PRE-ARRIVAL REQUIREMENTS — ADDITIONAL TERMS

G.1 Pre-Arrival Verification
The Sunset may require pre-arrival completion of:
(a) identity verification;
(b) guest information forms;
(c) payment confirmation;
(d) agreement to House Rules.

G.2 Access Contingent on Completion
No access credentials will be provided until all required steps are complete.

G.3 Right to Cancel Pre-Arrival
The Sunset may cancel the Reservation before arrival if:
(a) identity verification fails;
(b) fraud is suspected;
(c) payment cannot be confirmed;
(d) mandatory pre-arrival requirements are not completed.


H. UNIT CONDITION & HEALTH/SAFETY — ADDITIONAL TERMS

H.1 Health and Safety Standards
You must comply with:
(a) posted safety instructions;
(b) fire safety rules;
(c) evacuation procedures;
(d) sanitation practices.

H.2 Condition of Unit
You acknowledge that:
(a) units vary in design, configuration, furnishings, and condition;
(b) décor or layouts may differ from photos;
(c) minor wear and tear is expected.

H.3 Maintenance Access
The Sunset may enter for safety, inspections, repairs, or maintenance as permitted by law and this Agreement.

H.4 Safety Equipment
You may not disable or tamper with:
(a) smoke detectors;
(b) CO detectors;
(c) fire extinguishers;
(d) door locks;
(e) security systems.


APPENDIX A — HOUSE RULES

These House Rules (“House Rules”) apply to all Guests and visitors of The Sunset. They form an integral, binding part of the Terms of Service and are enforceable as contractual obligations. Violations may result in warnings, fees, relocation, termination of your stay, or removal from the Property, as permitted by Applicable Law.


1. GENERAL CONDUCT

1.1 Respectful Behavior
Guests must behave respectfully toward other guests, residents, staff, and neighbors at all times.

1.2 Prohibited Conduct
The following are strictly prohibited:
(a) harassment or abusive behavior;
(b) threats or intimidation;
(c) illegal activity;
(d) vandalism;
(e) disruptive conduct or disturbances.


2. OCCUPANCY LIMITS

2.1 Maximum Occupancy
You must not exceed the maximum occupancy listed for your unit.

2.2 Unregistered Guests
Unregistered overnight guests are prohibited unless expressly approved.


3. NOISE & QUIET HOURS

3.1 Quiet Hours
Quiet hours generally apply from 10:00 p.m. to 8:00 a.m., unless otherwise posted.

3.2 Noise Levels
You must maintain reasonable noise levels at all times and avoid disturbances to neighbors or other occupants.

3.3 Noise Monitoring Devices
Noise-monitoring devices may be present to ensure compliance. Triggering repeated alerts constitutes a violation.


4. PARTIES, EVENTS & GATHERINGS

4.1 No Parties
Parties, events, or social gatherings beyond the authorized number of people are prohibited.

4.2 Visitors
Visitors must comply with all rules and must leave the Property by posted visitor hours unless approved.

4.3 Unauthorized Events
Unauthorized events may result in immediate removal without refund and additional fees.


5. SMOKING & VAPING

5.1 No Smoking
Smoking or vaping of any substance is prohibited inside Accommodations and in any non-designated areas.

5.2 Violations
Violations may result in cleaning fees, damage charges, and/or termination of your stay.


6. PETS

6.1 Pet Policy
Pets are only allowed in units where expressly stated.
Unauthorized pets may result in additional fees.

6.2 Pet Conduct
Where permitted, pets must be supervised, leashed in common areas, and must not disturb others.


7. SAFETY & SECURITY

7.1 Lock Doors
Guests must lock all doors when leaving the unit.

7.2 Propping Doors
Propping open building or exterior doors is strictly prohibited.

7.3 Tampering with Safety Equipment
Tampering with:
(a) fire alarms,
(b) smoke detectors,
(c) CO detectors,
(d) fire extinguishers, or
(e) security systems
is strictly prohibited.

7.4 Weapons
No weapons, including firearms or ammunition, may be brought onto the Property except as expressly permitted by law and disclosed in advance.


8. CLEANLINESS & WASTE DISPOSAL

8.1 Cleanliness Standards
Guests must maintain reasonable cleanliness standards during their stay.

8.2 Garbage Disposal
All trash must be placed in the designated bins or disposal areas.

8.3 Sanitation
Guests must store food properly to prevent pests.


9. PARKING (IF APPLICABLE)

9.1 Parking Designation
Use only designated parking spaces if provided.

9.2 Unauthorized Vehicles
Unauthorized or improperly parked vehicles may be towed at the guest’s expense.


10. DELIVERIES & MAIL

10.1 Mail Delivery
Mail and packages may not be delivered to your unit unless specifically permitted.

10.2 Package Liability
The Sunset is not responsible for lost, misplaced, or stolen packages.


11. AMENITIES (AS AVAILABLE)

11.1 Availability Not Guaranteed
Amenities, if offered, may be unavailable due to maintenance or operational constraints.

11.2 Shared Amenities
Guests must follow all posted rules for any shared amenity.


12. DAMAGES & FEES

12.1 Guest Responsibility
Guests are responsible for any damage caused by themselves or invitees.

12.2 Reporting
Damage must be reported promptly.

12.3 Assessment
Fees may be assessed for:
(a) damage;
(b) unauthorized pets;
(c) smoking violations;
(d) excessive cleaning;
(e) breach of these House Rules.


13. CHECK-IN & CHECK-OUT

13.1 Check-In
Check-in times and procedures are communicated at booking.
Early access is not guaranteed.

13.2 Check-Out
Guests must vacate the unit by the specified check-out time.

13.3 Late Departure
Late departures may incur fees and may be treated as an overstay.


14. ENTRY & ACCESS

14.1 Access Credentials
Guests must safeguard keys, fobs, PINs, or digital codes.
Loss may incur replacement fees.

14.2 Unauthorized Access
Guests may not provide building or unit access to unauthorized persons.

14.3 Right of Entry
Staff may access units as permitted under the Terms of Service.


15. PROHIBITED ITEMS

15.1 Hazardous Materials
The following are prohibited:
(a) explosives;
(b) flammable liquids;
(c) toxic substances;
(d) illegal drugs;
(e) fireworks.

15.2 Appliance Restrictions
Unauthorized appliances (e.g., space heaters, hot plates) may not be used.


16. COMPLIANCE & ENFORCEMENT

16.1 Cooperation Required
Guests must comply with staff instructions relating to safety, security, and Property management.

16.2 Violations
Violations of these House Rules may result in:
(a) warnings;
(b) additional fees;
(c) cancellation without refund;
(d) immediate removal from the Property, as permitted by law.


17. CHANGES TO HOUSE RULES

17.1 Modifications
The Sunset may update these House Rules at any time.
Updates are effective upon posting on our website and apply to all stays not yet completed.
